SaPiC — Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the SaPiC application and related services (“SaPiC”, the “Service”, “we”, “us” or “MAPEDEON”).

By creating a SaPiC account or using SaPiC, you agree to these Terms and the SaPiC Privacy Policy.

If you do not agree to these Terms, you must not use SaPiC.

1. About SaPiC

1.1 The Service

SaPiC is an educational application designed to support the development of critical-thinking skills through interactive exercises, structured tasks, automated assessment, feedback and AI-supported educational functionality.

Depending on the functionality made available, SaPiC may include:

•interactive critical-thinking exercises;

•questions and tasks;

•written responses;

•automated assessment;

•assessment rubrics;

•scores and performance information;

•explanations and feedback;

•AI-assisted analysis;

•an AI Tutor;

teacher-created or teacher-assigned tasks; and

other educational tools and resources.

SaPiC is intended as an educational aid and does not replace teachers, tutors, parents, carers or other appropriately qualified professionals.

2. Eligibility and Age

2.1 Minimum Age

SaPiC is available only to users aged 13 or over.

You must not create or use a SaPiC account if you are under 13.

You must provide truthful information when asked to confirm your eligibility to use the Service.

MAPEDEON may use reasonable and proportionate measures to prevent or restrict access by users who do not meet the minimum age requirement.

2.2 Users Aged 13–17

SaPiC may be used by users aged 13–17.

Because SaPiC may therefore be accessed by children, MAPEDEON designs and operates the Service having regard to applicable data-protection requirements concerning children's personal information.

2.3 Purchases by Users Aged 13 or Over

Where AI Credits or other paid functionality are made available, users aged 13 or over may make purchases where permitted by the relevant payment platform and applicable law.

A user is responsible for ensuring that they are authorised to use the payment method provided.

Nothing in these Terms is intended to determine or alter the legal capacity of a particular individual to enter into a contract where applicable law provides otherwise.

3. Accounts

3.1 Creating an Account

Some SaPiC functionality requires an account.

Users create and maintain their own SaPiC accounts.

Teachers do not create student accounts on behalf of students.

3.2 Account Information

You must provide accurate information when creating or maintaining your account.

You must not deliberately provide false information or impersonate another person.

3.3 Account Security

You are responsible for:

•keeping your password and authentication information secure;

•preventing unauthorised access to your account;

not deliberately sharing your credentials; and

notifying MAPEDEON if you believe your account has been compromised.

4. Learning Level and Preferences

4.1 Default Learning Level

When a user first uses SaPiC, the Service assumes a default learning level of Key Stage 3 (KS3) unless the user changes this setting in Preferences.

The purpose of this setting is to establish an appropriate default level of language and educational explanation.

4.2 Learning Level Is Not Age

The learning level selected in SaPiC is a learning and language preference.

It is not intended to establish, verify or represent the user's actual age.

For example, an older student may deliberately choose a younger learning level because they prefer simpler explanations.

A user may also choose a more advanced level because they prefer more sophisticated language or greater depth.

Accordingly, the selected learning level is not treated as:

•the user's date of birth;

•proof of age;

an age-verification result; or

a definitive statement of the user's actual age.

4.3 Effect of the Setting

The selected learning level may affect:

•vocabulary;

•sentence structure;

•terminology;

•complexity;

•explanatory depth;

•examples;

feedback style; and

AI Tutor language.

The setting does not necessarily alter the underlying subject matter, assessment criteria or factual basis of a task.

4.4 Changing the Preference

Users may change their learning-level preference through the available Preferences controls.

Changing the learning level does not change the user's minimum-age status or any separate age information held for legal or account-management purposes.

5. Student Learning Information and Teacher Access

5.1 Student-Generated Information

A significant proportion of information generated within SaPiC originates from information entered or submitted by the student.

This may include:

•written responses;

•answers;

•task responses;

•explanations;

•arguments;

•hypotheses;

•other educational text;

•AI analysis;

•feedback;

•scores;

assessments; and

performance or progress information derived from the student's work.

5.2 Independent Student Use

A student may use SaPiC independently.

Information generated through independent use is not automatically made available to a teacher.

A teacher does not receive unrestricted access to a student's complete SaPiC account, complete learning history or all information generated by that student.

5.3 Teacher-Created or Assigned Tasks

A teacher may create or assign a task through SaPiC.

Where a student completes such a task, information associated with that particular task may be made available to the relevant teacher.

Depending upon the functionality being used, this may include:

•the student's name or identifier;

•the student's response;

•scores;

•assessment results;

•feedback;

task-specific performance information; and

other information directly associated with that task.

Teacher access does not provide unrestricted access to the student's account.

5.4 Teacher Responsibilities

Teachers using SaPiC agree to:

•use student information only for legitimate educational purposes;

•keep their account and access credentials secure;

•not seek access to information to which they have not been given access;

•not unnecessarily disclose student information;

take reasonable steps to protect information they download or export; and

securely delete external copies when they are no longer required.

5.5 External Copies

If a teacher downloads, exports, screenshots, prints, copies or otherwise stores information outside SaPiC, that copy is outside MAPEDEON's direct technical control.

MAPEDEON cannot remotely delete such an independently held copy.

Responsibility for handling and deleting such copies rests with the person or organisation that holds them, subject to applicable law.

6. The MAPEDEON Educational Platform

6.1 Connected Applications

SaPiC may form part of a wider suite of educational applications and services operated by MAPEDEON.

MAPEDEON may develop applications that are designed to work together using a common MAPEDEON account or workspace.

6.2 Transfer Between MAPEDEON Applications

Where a user chooses to use another MAPEDEON application that is integrated with SaPiC, relevant information may be transferred between the applications where necessary to provide the requested functionality or a connected learning experience.

Depending on the functionality involved, this may include:

•the MAPEDEON account identifier;

•email address;

•name or display name;

•learning-level preference;

•relevant educational responses;

•AI-generated analysis;

•feedback;

•scores;

•assessment results;

progress information; and

other information reasonably necessary for the receiving application.

6.3 Data Minimisation

MAPEDEON will seek to transfer only information reasonably necessary for the receiving application.

The existence of a connection between applications does not mean that another application automatically receives a user's complete account or complete learning history.

6.4 Optional or New Uses

Where a transfer represents an optional or materially different use of personal information, MAPEDEON may provide additional information and, where required by applicable law, obtain consent or provide another appropriate lawful mechanism before the new processing takes place.

6.5 Account Identity

The MAPEDEON platform may use a unique internal account identifier to recognise the same user across connected applications.

An email address may be used for account management or authentication but is not necessarily the primary internal identifier used to link applications.

6.6 Privacy Across the Platform

Information transferred between MAPEDEON applications remains subject to applicable MAPEDEON privacy, security, retention and data-protection requirements.

Use of one MAPEDEON application does not automatically give another user, teacher or third party unrestricted access to the user's information.

7. Deletion of Data

7.1 Delete My Data

Where available, SaPiC provides a “Delete My Data” function designed to allow users to delete relevant learning information.

This may include:

•submitted text;

•responses;

•AI analysis;

•AI feedback;

•scores;

•assessments;

•performance information;

learning metrics; and

other associated learning information.

Where information has been transferred to another MAPEDEON application, deletion will be handled in accordance with the applicable platform-wide deletion processes and the Privacy Policy.

7.2 Lawful Retention

Deletion is subject to information that MAPEDEON is legally required or otherwise lawfully entitled to retain.

Backup copies may remain temporarily as part of normal technical backup and recovery procedures.

Such copies will be protected and will not ordinarily be returned to active use except where necessary for lawful or technical purposes.

7.3 External Copies

MAPEDEON cannot remotely delete information that has been independently exported, copied or stored outside MAPEDEON systems.

8. AI Credits and Purchases

8.1 Free Access

SaPiC may be downloaded and used without charge for certain functionality.

Other functionality may require AI Credits.

8.2 AI Credits

AI Credits are prepaid digital credits that provide access to specified AI-powered functionality within SaPiC.

Credits:

•have no cash value;

•are not electronic money;

•are not a bank balance;

•are not redeemable for cash;

may not be transferred or sold unless expressly permitted by MAPEDEON; and

may only be used for the functionality specified within SaPiC.

8.3 Credit Costs

The number of Credits required for an operation may vary depending on the functionality and technical processes required.

The applicable Credit cost will be displayed where reasonably practicable before an operation is submitted.

MAPEDEON may change the Credit cost of future operations.

Such changes do not automatically alter the number of Credits already supplied.

8.4 AI Output

Purchasing Credits provides access to specified AI functionality.

It does not guarantee:

•a particular answer;

•a particular score;

•a particular quality of feedback;

•a particular AI model;

•uninterrupted availability;

a particular response time; or

a particular educational outcome.

9. Cancellation and Refunds for Digital Credits

AI Credits constitute digital content supplied electronically.

Where permitted by law, purchases are intended to be final and non-refundable once Credits have been supplied or used.

Nothing in these Terms excludes or restricts mandatory statutory consumer rights.

For digital content supplied electronically, a consumer may lose the statutory cancellation right where the consumer has expressly consented to immediate supply and acknowledged that the right to cancel will be lost once supply begins.

MAPEDEON will use an appropriate purchase process to obtain that consent and acknowledgement where applicable.

The purchase process may contain the following separate confirmations:

☐ I expressly request that MAPEDEON Limited supplies my purchased AI Credits immediately.

☐ I acknowledge that, once supply of the AI Credits begins, I may lose my statutory right to cancel this purchase.

The order control will also clearly indicate that placing the order creates an obligation to pay.

MAPEDEON will not rely upon this provision to remove statutory rights that cannot legally be excluded.

Consumers may retain statutory rights where digital content is defective, not as described or otherwise fails to meet mandatory legal standards.

10. Failed or Interrupted AI Operations

Where an AI operation consumes Credits but demonstrably fails because of a technical failure within MAPEDEON's own systems, MAPEDEON may, where technically and commercially practicable, restore or replace the affected Credits.

An inaccurate, incomplete or unexpected AI response does not necessarily mean that the technical operation failed.

Where an operation has successfully been submitted and processed, Credits may be treated as consumed even if the resulting output is unsatisfactory.

This does not affect mandatory statutory rights.

11. Third-Party Services

SaPiC may depend upon third-party services including:

•AI and large-language-model providers;

•cloud infrastructure;

•hosting;

•authentication;

•APIs;

•payment providers;

•application stores;

security services; and

other technology providers.

Third-party services may become unavailable, overloaded, restricted, changed, suspended or discontinued.

Providers may also:

•change their APIs;

•change or discontinue AI models;

•impose rate limits;

•change pricing;

introduce technical restrictions; or

terminate services.

MAPEDEON cannot guarantee that third-party services will remain available or unchanged.

To the maximum extent permitted by law, MAPEDEON is not responsible for loss caused solely by the failure, interruption, unavailability, modification or discontinuation of a third-party service where the event is outside MAPEDEON's reasonable control.

MAPEDEON may modify, replace, suspend or discontinue SaPiC functionality that depends upon third-party services.

The standard SaPiC service does not necessarily automatically substitute a different paid AI service if an underlying AI service becomes unavailable.

12. AI-Generated Content

AI-generated information may contain errors.

AI output may be:

•inaccurate;

•incomplete;

•outdated;

•ambiguous;

•inconsistent;

inappropriate for a particular context; or

affected by limitations in the underlying technology.

AI-generated content should therefore be treated as educational assistance rather than infallible information.

Users and teachers should exercise appropriate judgement when relying upon AI-generated information.

13. Automated Assessment

SaPiC may use automated rules, rubrics, AI analysis or combinations of these technologies to assess responses.

Automated assessment is intended to support learning and feedback.

It is not guaranteed to reproduce the judgement of a teacher or other qualified professional.

Where an assessment may have significant educational consequences, appropriate human judgement should be applied.

14. Academic Integrity

Users are responsible for complying with the academic-integrity rules of their school, college, university or other educational organisation.

SaPiC does not determine whether a particular use of AI is permitted by an educational institution.

MAPEDEON is not responsible for disciplinary, examination or academic consequences arising from a user's use of SaPiC.

15. Service Availability

MAPEDEON will use reasonable efforts to maintain the Service but does not guarantee that SaPiC will always be:

•available;

•uninterrupted;

•error-free;

•compatible with every device;

compatible with every operating-system version; or

available at a particular speed.

The Service may be temporarily unavailable because of maintenance, upgrades, security measures, technical problems, third-party failures or circumstances outside MAPEDEON's reasonable control.

16. Acceptable Use

You must not:

•use SaPiC unlawfully;

•access another person's account without authorisation;

•interfere with the security or operation of the Service;

•circumvent access controls;

•upload malicious code;

•impersonate another person;

reverse engineer the Service except where applicable law expressly permits this; or

use SaPiC in a way that creates a material risk to other users or the Service.

Users should avoid submitting unnecessary sensitive personal information about themselves or others.

17. Intellectual Property

MAPEDEON and its licensors retain all rights in SaPiC, including its software, design, interfaces, branding, educational frameworks and underlying technology, except for material owned by users or third parties.

Subject to these Terms, MAPEDEON grants you a limited, non-exclusive, non-transferable right to use SaPiC for its intended educational purposes.

You retain ownership of original material that you submit to SaPiC, subject to the rights necessary for MAPEDEON and its service providers to process that material to provide the Service.

18. Privacy

MAPEDEON's processing of personal information is described in the SaPiC Privacy Policy.

The Privacy Policy explains:

•what information is processed;

•how information is generated and used;

•AI processing;

•teacher access;

•connected MAPEDEON applications;

•deletion;

•retention;

•third-party service providers;

international transfers; and

data-protection rights.

The Privacy Policy forms part of these Terms.

19. Suspension and Termination

MAPEDEON may suspend or terminate an account where reasonably necessary to:

•protect the Service;

•address security concerns;

•prevent misuse;

comply with legal obligations; or

enforce these Terms.

Users may stop using SaPiC at any time.

Termination does not require MAPEDEON to delete information that it is legally required or otherwise lawfully entitled to retain.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Subject to that limitation, MAPEDEON is not responsible for:

•losses caused solely by third-party service failures outside its reasonable control;

•loss resulting from failure to maintain account security;

•loss resulting from information exported or copied outside SaPiC;

•reliance upon inaccurate or unsuitable AI-generated information;

educational, disciplinary or academic outcomes resulting from reliance upon automated assessment; or

failures caused by a user's device, operating system, internet connection or other equipment outside MAPEDEON's control.

Nothing in these Terms removes statutory consumer rights.

21. Changes to SaPiC

MAPEDEON may modify, improve, replace or discontinue features of SaPiC.

Where a change materially affects users' rights or obligations, MAPEDEON will provide appropriate notice where required by law.

22. Changes to These Terms

MAPEDEON may update these Terms from time to time.

The current version will be made available through SaPiC or an associated website.

Where required, users will be given appropriate notice of material changes.

23. Governing Law

These Terms are governed by the law of England and Wales, except where mandatory consumer protection law in the country in which a consumer lives provides otherwise.

Nothing in these Terms affects mandatory legal rights that cannot lawfully be excluded.
